1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of the cmoguntvn website and related training materials (the “Site” and the “Training”). The Site is operated by cmoguntvn Academy s.r.o. (“cmoguntvn”, “we”, “us”, or “our”). By visiting the Site, requesting registration details, or otherwise using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

You must be at least 16 years old to use the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian. If you do not agree to these Terms, do not use the Site.

2. Educational Training Disclaimer

The Training provides educational content for wooden furniture sales and showroom operations, including consultative scripts, product knowledge guidance, and practice routines. The Training is for informational and educational purposes only.

We do not guarantee sales performance, revenue increases, conversion rates, business results, or any specific commercial outcome. Results vary based on factors outside the Training, including but not limited to foot traffic, assortment, stock availability, price positioning, seasonality, staffing, local competition, and individual execution. Any examples described on the Site are illustrative and not promises of results.

3. Description of the Site and Training

The Site presents information about our wooden furniture sales training and allows visitors to request registration details. The Training may include written materials, lesson outlines, scripts, checklists, practice prompts, and other educational resources.

We may update, adjust, or discontinue parts of the Site or Training at any time, including changing lesson structure, modules, or guidance. We make no commitment to maintain any specific feature, page, or content indefinitely.

4. Registration Requests and Communications

When you use the registration form, you provide your name and email address so we can respond with intake details and access options. You agree that the information you submit will be accurate and not misleading.

We aim to respond within 1 business day, but response times can vary. Submission of the form does not create a contract for paid services, and it does not guarantee availability for any particular intake.

5. Acceptable Use

You agree to use the Site lawfully and responsibly. You must not:

  • Attempt to gain unauthorised access to the Site, servers, or systems, or to bypass security or rate limits.
  • Scrape, crawl, or harvest content or data from the Site using automated tools without our prior written permission.
  • Submit false, deceptive, or infringing information through forms or email.
  • Introduce malware, attempt phishing, or interfere with the Site’s normal operation, including denial-of-service activity.
  • Impersonate another person or misrepresent your affiliation with a company, showroom, or brand.
  • Use the Site in violation of applicable sanctions, export controls, or other laws and regulations.

We may suspend or restrict access to the Site if we reasonably believe these Terms have been violated or if your activity creates risk to other users or to the Site.

6. Intellectual Property

The Site and Training, including text, design, formatting, scripts, frameworks, trademarks, and other content, are owned by cmoguntvn Academy s.r.o. or licensed to us and are protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal or internal business evaluation purposes. You may not copy, reproduce, distribute, publish, publicly display, modify, translate, create derivative works from, or commercially exploit any part of the Site or Training without our prior written consent.

7. Third-Party Services and Links

The Site may refer to or integrate third-party services (for example, map links or browser features). Third-party sites and services are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or practices.

8. Disclaimer of Warranties

The Site and Training are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any content will be complete or suitable for your specific showroom, brand positioning, or local market.

9. Limitation of Liability

To the maximum extent permitted by law, cmoguntvn Academy s.r.o. and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site or Training, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total direct liability for any claim arising out of or relating to the Site or Training is limited to the greater of (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for intentional misconduct where such limitation is prohibited).

10. Indemnification

You agree to indemnify, defend, and hold harmless cmoguntvn Academy s.r.o. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) information you submit through the Site; (c) your violation of these Terms; or (d) your infringement of any intellectual property or other rights of any person or entity.

11. Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, fire, flooding, war, terrorism, labour disputes, pandemics, internet outages, cyberattacks, or failures of hosting, cloud, or telecommunications providers.

12. International Use

The Site is operated from Czechia. We make no representation that the Site or Training is appropriate or legally available in all jurisdictions. You are responsible for compliance with local laws where you access the Site.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Czech Republic, without regard to conflict of laws rules. Courts located in Czechia will have jurisdiction over disputes arising out of or relating to these Terms, unless mandatory consumer protection laws in your country of residence require otherwise.

Before starting formal proceedings, you agree to contact us and allow a 30-day period for informal resolution.

14. Termination

We may suspend or terminate your access to the Site if we believe you have violated these Terms or if your activity creates risk to the Site, users, or our operations. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and cmoguntvn regarding your use of the Site, and supersede any prior or contemporaneous communications on the subject.

17. Assignment

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, reorganisation, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. Any waiver must be in writing and signed by an authorised representative of cmoguntvn.

19. Modifications to These Terms

We may update these Terms from time to time. Changes become effective 14 days after posting on this page, unless a change is required by law or is administrative in nature. The “Last Updated” date at the top of this page indicates the most recent revision.

20. Electronic Communications

You consent to receive communications from us electronically (for example, by email). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
